The High Court of Himachal Pradesh dismissed a regular second appeal filed by a plaintiff, upholding the First Appellate Court’s decision to set aside a trial court decree that had favored the plaintiff. The Court ruled that establishing a right of way or easement by prescription requires precise pleadings detailing points of ingress, egress, width, and direction, which were absent here, and noted that admissions by the plaintiff’s own witness regarding an alternative wide public path rendered the claim unsustainable.
- Nature of Dispute: The plaintiff sought a declaration and injunction claiming a prescriptive right of way over a path passing through the defendants’ land. The trial court decreed the suit, but the First Appellate Court reversed it, prompting the present second appeal.
- Deficiencies in Pleadings and Evidence: The Court reiterated that claiming a right of way by prescription requires specific pleadings identifying the exact path, width, direction, and points of ingress and egress. Vague descriptions and an unproven tatima (map) prepared by a deceased draftsman whose authenticity remained unverified rendered the plaintiff’s claim unsupportable.
- Binding Admissions on Alternative Access: The testimony of the plaintiff’s own witness (PW-3) admitted the existence of an alternative, wide public path (3 to 6 meters wide) adjacent to his land connecting directly to the motorable road, which legally bound the plaintiff and disproved any necessity to cross the defendants’ property.
- Absence in Revenue Records: Given that recent settlement operations had occurred in the area, the complete absence of any recorded path in official revenue records further undermined the plaintiff’s version.
- Appellate Power to Reverse Joint Decrees: The Court affirmed that under Order XLI Rules 4 and 33 of the CPC, where a decree proceeds on a common ground, an appeal filed by only one defendant empowers the appellate court to reverse or vary the decree in favor of all parties sharing the same interest.
