The High Court of Himachal Pradesh addressed a service law dispute concerning the delay in regularizing contractual Lecturers (School-New) who had fulfilled their continuous service requirement by the prescribed cut-off date of 31.03.2024. The State authorities delayed issuing regularization orders until 06.07.2024, citing the enforcement of the Model Code of Conduct and relying on Condition No-IX of the regularization policy dated 02.12.2023, which mandated prospective regularization from the date of order issuance.
The Court held that once employees fulfill the criteria under the statutory rules and regularization policy, they acquire a fundamental right to be considered and regularized from the due date, and administrative roadblocks or the Model Code of Conduct cannot extinguish this right. Consequently, the Court declared Condition No-IX inoperative in cases where it is misconstrued to defeat vested regular status, allowing the writ petition with specific directions for retrospective financial and service benefits.
- Accrual of Fundamental Right: The petitioners were appointed as Lecturers (School-New) through a regular selection process under statutory Recruitment and Promotion Rules. Having completed two years of continuous service prior to the cut-off date of 31.03.2024, they gained a legitimate and fundamental right to be considered for regularization from 01.04.2024.
- Inapplicability of Model Code of Conduct: The Court rejected the State’s justification that the Model Code of Conduct for elections caused the delay. It ruled that the State was bound to apply the principle of restitution to restore the rights of the employees once the impediment was lifted, as the delay was entirely attributable to the administration.
- Legitimate Expectation and Past Practice: Deviating from consistent past practices of granting regularization from the date eligibility was completed violated the doctrine of legitimate expectation and constituted manifest arbitrariness under Article 14 of the Constitution.
- Condition No-IX Declared Inoperative: The Court found that Condition No-IX of the regularization policy—demanding prospective effect from the date of the order—conferred unbridled, arbitrary power and exploited the unequal bargaining power of employees. It was declared inoperative and inapplicable to the extent that it curtailed the petitioners’ vested rights.
- Final Directions: The writ petition was allowed, directing the respondents to reconsider the petitioners’ regularization from 01.04.2024, issue modified orders, fix pay scales, and disburse all consequential monetary benefits within a period of six weeks.
