The petitioners, appointed as Masons in a department lacking separate Recruitment and Promotion (R&P) Rules, possessed the essential qualifications prescribed for Masons in the Himachal Pradesh Public Works Department (HPPWD) and performed identical duties. The respondent-Department classified them as Class-IV employees and denied them the skilled pay scales admissible to Masons in the HPPWD and other departments. The High Court of Himachal Pradesh allowed the petition and quashed the rejection memorandum dated 30.07.2009. The Court ruled that denying pay parity to skilled workers performing identical duties, merely because they belong to a different department without specific R&P Rules, is arbitrary and violative of Articles 14 and 16 of the Constitution. However, invoking the limitation principle regarding financial arrears, the Court restricted actual monetary benefits to three years prior to the filing of the petition, granting notional benefits from the initial date of appointment.

  • Arbitrary Classification and Pay Parity:
    • Where no separate R&P Rules exist for a skilled post in a department, employees who possess the requisite qualifications and perform identical duties as their counterparts in other departments (such as HPPWD) cannot be arbitrarily classified as Class-IV workers or denied equivalent pay scales.
    • Treating skilled Masons at par with unskilled Beldars is arbitrary, discriminatory, and violates Articles 14 and 16 of the Constitution of India.
  • Restriction of Financial Arrears (Three-Year Rule):
    • While entitlement to pay fixation and correct pay scales cannot be denied solely on the ground of delay and laches, financial arrears must be restricted to three years prior to the institution of the petition when approached belatedly.

Arbitration: Nullity of Unilateral Appointments: High Court Sets Aside Arbitral Award

    • Conduct, oral consent, or mere participation in proceedings (such as a ‘no objection’ recorded in a procedural order) cannot substitute the mandatory requirement of an express written agreement, and is inconsequential.
