The petitioner, whose promotion recommendations to the post of General Manager were placed in a sealed cover due to pending disciplinary proceedings under Rule 16 of the CCS (CCA) Rules, was subsequently completely exonerated, with all audit objections and charges dropped. Although the respondent-Corporation promoted him to the post of General Manager notionally from the date his juniors were promoted (09.01.2015), it restricted his actual monetary benefits from the date of joining. The High Court of Himachal Pradesh allowed the writ petition, holding that where an employee is completely exonerated and kept away from discharging duties of a higher post through no fault of their own, the principle of “no work no pay” does not apply, entitling them to actual monetary and service benefits from the date their contemporaries were promoted.

  • Sealed Cover Procedure and Complete Exoneration:
    • When an employee’s promotion is withheld via a sealed cover due to pending disciplinary proceedings and they are subsequently completely exonerated of all charges without even being visited with a penalty of censure, they must be granted all benefits from the date their contemporaries were promoted.

Arbitration: Nullity of Unilateral Appointments: High Court Sets Aside Arbitral Award

    • The statutory bar under Section 12(5) can only be waived pursuant to the proviso if there is an express agreement in writing executed after the disputes have arisen.
    • Conduct, oral consent, or mere participation in proceedings (such as a ‘no objection’ recorded in a procedural order) cannot substitute the mandatory requirement of an express written agreement, and is inconsequential.
