- Allegations of fraud, misrepresentation, or coercion must be pleaded with specific and precise particulars under Order 6 Rule 4 of the CPC.
- General and vague averments or the mere use of the word “fraud” are insufficient, and a party cannot lead evidence on unpleaded matters.
- Finality of Partition Proceedings and Abandonment of Remedies:
- Where a party challenges partition proceedings on the ground of fraud but fails to actively pursue statutory appeals against revenue orders—resulting in the dismissal of such appeals in default—those orders attain finality.
- Attempting to reopen settled partition matters via a civil suit after an inordinate delay constitutes an abuse of the process of the court.
- Scope of Interference in Regular Second Appeal (Section 100 CPC):
- The High Court does not sit as a court of facts under Section 100 of the CPC, as the first appellate court is the final court of fact.
- Interference with concurrent findings of fact is restricted to limited grounds such as perversity, misreading of evidence, or reliance on inadmissible evidence, none of which were present in this case.
